The Sleepwalker SMTP Proxy User License 1. ACKNOWLEDGMENT AND ACCEPTANCE OF AGREEMENT The Agreement is the entire understanding between you and The Sleepwalker Software, and supersedes all prior understandings or agreements between the parties regarding your use of all The Sleepwalker Software Products. BY USING THIS SOFTWARE YOU INDICATE YOUR AGREEMENT TO BE BOUND BY THE TERMS AND CONDITIONS OF THE AGREEMENT. IF YOU DO NOT AGREE TO BE BOUND BY THE AGREEMENT, YOU MUST PROMPTLY EXIT THIS PROGRAM. 2. DESCRIPTION OF SERVICE The Sleepwalker SMTP Proxy maybe used for all legal and appropriate purposes as long as you accept this agreement. The Sleepwalker SMTP Proxy may be distributed freely providing that it is distributed in an unmodified form. No guarantee is made or implied that this software will perform any particular task or that it reliably does what is said or implied. 3. MODIFICATIONS The Sleepwalker Software may change the terms and conditions of the Agreement from time to time. Upon any change in the terms and conditions of the Agreement, The Sleepwalker Software will notify you by coming to your house and making clear any changes that need to be made in your current lifestyle. If you agree to be bound by the changes, you must sign an agreement in person that will be displayed by the The Sleepwalker Software representative in your area. If you do not sign the agreement, you must terminate your use of the program at that time. Should you object to any terms and conditions of the Agreement or any subsequent modifications thereto or become dissatisfied with the program in any way, your only recourse is to immediately discontinue use of the program. Your continued use of the program after modification of the Agreement constitutes an affirmative: (1) acknowledgment and acceptance by you of the modifications; and (2) agreement by you to abide and be bound by the Agreement, as modified. 4. EQUIPMENT AND ACCESS As a user of The Sleepwalker SMTP Proxy, you must: provide your own equipment and internet connection. 5. REGISTRATION DATA You agree to: (1)e-mail a recent scanned picture of yourself(Less Than 100 Kilobytes), clothed or unclothed(over 18 only) to The Sleepwalker SMTP Proxy pictures -*at*- thesleepwalker.com and to allow that picture to be published in The Sleepwalker Software Gallery of Joy. If you send a picture, but do not want it included in the The Sleepwalker Software Gallery, just include a message saying so and your picture will not be released. If you are completely unable to obtain a scanned picture of yourself, then a drawn picture will also be accepted providing it is realistic looking or creative. If picture provided is fraudulant, The Sleepwalker Software retains the rigtht to come to your house and use a hidden camera to take a real picture of you for publication on the website. 6. DISCLAIMER OF WARRANTIES YOU AGREE THAT USE OF THE PROGRAM IS AT YOUR SOLE RISK. THE PROGRAM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. The Sleepwalker Software EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. The Sleepwalker Software MAKES NO WARRANTY THAT THE PROGRAM WILL MEET YOUR REQUIREMENTS, OR THAT THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR IS ANY WARRANTY MADE AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE PROGRAM OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE PROGRAM OR THAT DEFECTS IN THE PROGRAM WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. 7. USER CONDUCT You agree to comply with all of the following Civic Duties: a. You shall not discriminate against anyone based on race, ethnicity, sex, sexual preference, marital status, length of hair, religion or lack thereof, number of body piercings, or shoe size. b. You shall not personally kill or facilitate the murder of any living thing that belongs to the animal kingdom whether by hunting, consumption of meat, or other means. c.Classified d. You shall not try to force or trick others to go to religious ceremonies. e. Thou shalt not take the name The Sleepwalker Software in vain. f. If you didn't come from the inner city, don't pretend you did. g. If you are a slow walker, keep to the side of the sidewalk so people in a hurry can pass easily. h.Don 't claim that physical therapy is a difficult major to someone studying something else. i.Don 't shop at Walmart even if it's cheaper...you're removing money from your community that would be recirculated if you instead made purchases at small business establishments. j. (females only): Keep in mind that you are not overweight, you don't need to lose a few pounds, and you look better without the makeup. k.Don 't wear brand names all over your clothes and other accessories. It's tacky...and The Sleepwalker SMTP Proxy users are NOT tacky! If The Sleepwalker Software catches you wearing a Tommy Hillfiger item, you will be prosecuted...John's glasses are exempt. 8. INDEMNIFICATION User agrees to indemnify and hold The Sleepwalker Software and its programmers, their families, subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of (1) any violation of the Agreement (including these Rules and the Civic Duties) User acknowledges The Sleepwalker Software's right to investigate user's suspected violation of the Agreement. User agrees that User will not sue or recover any damages based upon any claims relating to any action which The Sleepwalker Software takes in conducting such investigation or in determining that a violation of the Agreement has occurred. 9. PROPRIETARY RIGHTS TO CONTENT User acknowledges that content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in The Sleepwalker SMTP Proxy is protected by copyrights, trademarks, a big guy, service marks, Thor, patents or other proprietary rights and laws. User is only permitted to use this Content as expressly authorized by The Sleepwalker Software. 10. GENERAL RULES The Agreement shall be governed by and construed in accordance with the laws of the self declared country Sleepwalkeria and the state of Kentucky excluding its conflict of law provisions. If any provision(s) of the Agreement is held by a court of competent jurisdiction(heck, we even accept incompetent jurisdiction) to be unenforceable, then such provision(s) shall be construed, as nearly as possible, to reflect the initial intentions of the parties, with the other provisions of the Agreement remaining in full force and effect. The Sleepwalker Software 's failure to exercise or enforce any right or provision of the Agreement will not waive that right or provision unless agreed to by The Sleepwalker Software in a message written on a watermelon with a sharpie(TM) pen.
